1. Services & Subscriptions

Heavenly Gardens provides recurring landscape stewardship and estate maintenance plans ("Starter", "Garden", "Estate" tiers) for residential and commercial properties in Dubai and selected communities across the UAE. Subscriptions are billed on a recurring basis (monthly, quarterly, half-yearly, or yearly) depending on the plan selected at checkout.

2. Customer Responsibilities & Property Access

To enable our teams to deliver uncompromised service quality, subscribers agree to:

• Provide safe, unobstructed access to the garden, lawn, and irrigation equipment during scheduled visit windows.
• Ensure domestic pets are safely secured prior to our team's arrival.
• Maintain adequate water and electrical utility supply required for irrigation testing and equipment operations.
• Notify our office of any gate codes, security clearances, or community security passes required for access.

3. Service Scheduling & Weather Rescheduling

Visits are scheduled according to your subscription tier frequency. While we make every effort to maintain fixed visit dates, adjustments may occur due to severe sandstorms, extreme summer heat advisories, torrential rainfall, or official UAE public holiday mandates. In such events, Heavenly Gardens will reschedule the visit to the earliest available alternative date without penalty.

4. Pricing, Taxes & Payment Gateway

All prices quoted on the website are displayed in United Arab Emirates Dirhams (AED). Pursuant to UAE Federal Tax Authority (FTA) laws, a 5% Value Added Tax (VAT) is applied to all invoices and checkout totals.

Online credit and debit card payments are processed securely through our acquiring banking partner, Abu Dhabi Islamic Bank (ADIB). By placing an order, you confirm authorization to charge the designated payment instrument. Payments are settled in AED.

5. Cancellation & Subscription Renewal

Subscriptions automatically renew at the end of each billing cycle unless cancelled prior to the renewal date via the Customer Account Dashboard or by written notice to hello@heavenlygardens.ae. Please refer to our detailed Cancellation Policy for notice requirements.

6. Limitation of Liability & Force Majeure

Heavenly Gardens shall not be liable for indirect, incidental, or consequential damages resulting from pre-existing plant diseases, underlying soil degradation, subterranean pipe defects, or force majeure events beyond our reasonable control (including severe climate anomalies or government restrictions). Our maximum aggregate liability under any contract shall not exceed the subscription fees paid by the client in the preceding 30 days.

7. Intellectual Property & Governing Law

All logos, design aesthetics, photography, and bespoke garden design concepts published on this website are the sole property of Heavenly Gardens.

These Terms and Conditions are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai. Any dispute arising out of or in connection with these terms shall be referred to the exclusive jurisdiction of the Dubai Courts.
